ARTICLE 1. PURPOSE AND DEFINITIONS 

1.1 Purpose of the Privacy and Data Protection Policy 

CELLKRAFT is committed to ensuring transparency and integrity in the use of data and adequate security and confidentiality of any such used data that may directly or indirectly identify its customers (hereinafter referred to as “Personal Data”) when browsing our website. 

This Privacy and Data Protection Policy (hereinafter the “Policy”) informs you about the Personal Data collected from you or through third parties, about how these Personal Data may be used and communicated, how you can control the use and disclosure of your Personal Data and how your Personal Data is protected, in accordance with the provisions of the European Union Regulation 2016/679 on the protection natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter “GDPR”) and the Federal Data Protection Act Bundesdatenschutzgesetz.  

Please note that the Policy may be updated at any time by CELLKRAFT. The date of the most recent update will appear on this page. We therefore invite you to consult it regularly. 

This Policy applies to all services offered by CELLKRAFT, with the exception of services governed by a specific Policy. 

Where a service has a specific Policy, the provisions of that Policy shall prevail over this Policy. 

2.2 Identity of the Data Controller 

The person responsible for processing your Personal Data is CELLKRAFT, GmbH with a share capital of €25,000 and registered office at VILLAFRANCE Worringer Strasse 30 50668 KÖLN.

ARTICLE 2. DATA COLLECTION 

  1. 1. What personal data is collected?

We collect your personal data directly from you when you fill out a form on our website. 

The personal data collected are related to your identity (name, surname, telephone number, email address), and are used by CELLKRAFT to assist you in the purchase of your equipment and more generally, for the performance of our contractual obligations. 

The processing and collection of personal data by CELLKRAFT is based on your consent and on any possible contractual relationship between us. 

2.2 What are cookies? 

Cookies are small files that are used and stored on your device (computer, tablet, mobile phone or any other internet-enabled device). They are essentially used to make a website work and to improve its functioning, while collecting information about your browsing on it.

ARTICLE 3. PURPOSES OF COLLECTING PERSONAL DATA  

3.1 How are your personal data used? 

The data collected by CELLKRAFT is processed to : 

  • Enable you to use our website; 
  • Evaluate and improve our website and the related functionalities in order to enhance your user experience; 
  • Provide you with customer support and respond to your enquiries; 
  • Respond to your requests for assistance and implement the legal and contractual guarantees attached to your equipment; 
  • Fulfil our legal and contractual obligations to the best of our ability, or to respond to requests from public and governmental authorities; 
  • Subject to your prior consent, if necessary, to carry out commercial prospecting operations with you, in accordance with your personal choices; 

3.2 Are your personal data transferred? 

In the course of its activities, CELLKRAFT may be required to transfer certain data, including personal data, in a secure manner to its internal personnel, as well as to third parties, both private and public, to ensure the performance of tasks necessary for the execution of the contract. 

E.g.: complaint management, delivery organization, administrative procedures… 

Your personal data will not be transmitted to third parties outside the European Union. 

ARTICLE 4. HOW LONG PERSONAL DATA ARE KEPT  

Personal data of persons who have not entered into a contract with CELLKRAFT, and who remain inactive in the database, shall be kept for a maximum period of three years, starting from the last contact between CELLKRAFT and the person concerned. 

If the collection of this data is based on your prior consent, the data will be deleted before the expiry of this three-year period in case of withdrawal of your consent. 

In general, CELLKRAFT keeps the data of its customers for as long as is necessary for the fulfilment of the purposes for which it was collected. 

In case of conclusion of a contract, the personal data collected are kept for a period of 10 years.

ARTICLE 5. DATA STORAGE PROCEDURES 

5.1 Where is the personal data collected stored? 

The personal data collected by CELLKRAFT is stored on its content management tool, known as “CMS WORDPRESS”, used by CELLKRAFT and its staff. 

5.2 How is data security ensured? 

CELLKRAFT undertakes to take all necessary precautions and appropriate organizational and technical measures to guarantee a level of security appropriate to the risk, in particular involving the implementation of means to preserve the security, integrity and confidentiality of your Personal Data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties. 

To this end, CELLKRAFT has put in place security measures on its premises through the use of an alarm and a video surveillance system, as well as restricted access requiring authentication by badge. 

Its IT environment is also secured via antivirus software and network firewalls. 

Nevertheless, the security and confidentiality of Personal Data is also based on everyone’s best practices.  

ARTICLE 6. EXERCISE OF YOUR RIGHTS 

6.1 What are your rights? 

In accordance with the applicable regulations on the protection of Personal Data, you have the right to access and copy, rectify, delete and limit the processing of your data, as well as the right to withdraw your consent at any time. 

A right of access and copy: 

This right consists in obtaining confirmation from CELLKRAFT as to whether or not your Personal Data are being processed. Where Personal Data are being processed, you have the right to review said Personal Data. CELLKRAFT will then provide you with a copy of the Personal Data processed by it. 

A right of rectification: 

This right consists in obtaining from CELLKRAFT the rectification of Personal Data concerning you that are inaccurate. You have the right to have your incomplete Personal Data completed, including by providing a supplementary statement. 

A right of deletion: 

This right consists in obtaining from CELLKRAFT the deletion, as soon as possible, of Personal Data concerning you. 

A right to limitation of processing: 

This right consists in obtaining from the data controller the limitation of the use made of your data: 

  • When you dispute the accuracy of Personal Data. This processing limitation will then apply the necessary time allowing CELLKRAFT to verify the accuracy of the data. 
  • If the processing is unlawful and you want CELLKRAFT to restrict the use of your data without deleting them 
  • If CELLKRAFT no longer needs your Personal Data in view of the processing carried out, but you consider that the Personal Data are still necessary for the establishment, exercise or advocacy of rights before the courts. 
  • If you have objected to the processing of your data (in accordance with your right of objection). This limitation of processing will then apply the time necessary for CELLKRAFT to verify whether its legitimate grounds pursued prevail over the grounds relied on by you. 

6.2 How to exercise your rights?

If you consider that your rights regarding your Personal Data have not been respected by CELLKRAFT, you can submit your complaint directly to the Commission Nationale de l’Informatique et des Libertés (CNIL), by mail to CNIL – Service des Plaintes – 3 Place de Fontenoy – TSA 80715 – 75334 PARIS CEDEX 07, or via the online complaint service accessible on the CNIL website.
